Aviation Law
We offer comprehensive legal services to a wide range of clients in the aviation industry, including airlines, banks, finance and operating lessors, investors, aircraft manufacturers, and other aviation-related businesses. We advise on aircraft transactions such as aircraft purchase, sale, finance and lease arrangement, aircraft registration and deregistration, aviation regulatory compliance and aviation dispute. We advise and assist our clients in liaising with government and regulatory agencies, and in obtaining relevant licenses, permits and other approvals.
The Firm’s Partners have extensive experience in aviation law practice, having provided the following legal services in aviation:
- Advised a local airline and travelers on passengers’ rights under the Nigerian Civil Aviation laws and regulations as well as under the Federal Competition and Consumer Protection Act, 2018.
- Advised a company registered in the British Virgin Islands on the options available to it for the repossession of 2 (two) fixed-wing Bombardier Q300s aircraft. This advice was rendered under the provisions of Nigeria’s Civil Aviation Act LFN 2014 which domesticated the Convention on International Interests in Mobile Equipment, 2001 and the Protocol to the Convention on International Interest in Mobile Equipment on matters specific to Aircraft Equipment 2001 otherwise known as the Cape Town Convention and Protocol.
- Successfully de-registered [two] Bombardier Dash 8 Q300 Series Aircraft through the Nigerian Civil Aviation Authority
- Defended a foreign aircraft owner in an action filed by a local aircraft lessee for the preservation of two Bombardier Dash 8 Q300 Aircraft from repossession and the exercise of the right of first purchase.
- Reviewed Aircraft Lease Agreement between a local and international airline.
- Reviewed a private aircraft charter agreement on behalf of a foreign client.
- Advised a local airline and an aircraft manufacturer regarding potential product liability claims against them in Nigeria.
- Advised a global aircraft manufacturer, on both substantive and procedural laws regarding aviation-related suits and claims in Nigeria.
- Advised a local financial institution regarding its financing of the acquisition of an aircraft for its customer and the creation of security interest over the aircraft.
- Drafted and negotiated an aircraft finance facility agreement and mortgage deed on behalf of a financial institution.
